* Is it mandatory for a local guardian to be appointed?
No, it is not under ICA? MOE’s guidelines to require a local guardian.
* Parents should have first priority to sign instead of guardian.
If the overseas parents are able to sign, then they should have priority over the guardian, unless the parents are overseas, in prison or in some other manner incapacitated.
* When guardian is signing (whether this guardian is local or overseas)
Where the guardian (overseas or local) is signing instead of parents, there should be documentation to verify that the guardian is indeed the legal guardian (you may wish to verify this with your legal officers)
* Note – Local sponsor required by ICA does not mean he is the local guardian
ICA requires local sponsors who would be responsible that the student do not breach the terms under the security bond. A sum will also be deposited with the ICA as part of this security bond.
* Note – can the local guardian and local sponsor ( for security bond) be the same person?
Yes. As far as ICA guidelines are concerned, there is also no restriction of a person serving as both sponsor and guardian.
* Note – School staff should not be advised to act as Guardian
We hope to reap caution in the event where the school (staff) requests to act as guardian. From EDB/CASE’s perspective, this is certainly not advisable as if this is done, both parties of the escrow confirmation would be from the same entity – the guardian (school staff) and the school.
